PRINCIPLE TERMS

This agreement commences once you have completed the joining process and your membership starts immediately.

You will be entitled to all the rights and privileges exercisable for the type of membership chosen.

You must be 16 years or over to join Inis Fitness.

Memberships are not transferrable.

 

MEMBERSHIP FEES

When you become a member, the membership fees are due from the date your membership begins.  This payment is made in advance and in accordance of your membership term.

All types of memberships have their own fee and conditions.

You cannot transfer your membership or pass to someone else.  It concerns a personal membership.

Membership is paid monthly on a subscription payment basis or in a once off payment

All new subscription payment memberships are processed by a third party on behalf of Inis Fitness.

The first month’s membership fee is collected by credit/debit card on your membership application date upon joining online.

Your second monthly membership fee will be collected one month after you have joined and will be collected on the same date (or the closest working day each month of your membership). Please take note of the dates shown for your records.

Subscription payments will continue on a monthly basis until you notify Inis Fitness of your wish to cease your membership. Cancellation requests must be sent at least two weeks prior to the collection date and you must also inform your bank.

Non-payment of a subscription payment will result in your membership being automatically cancelled. The prevailing advertised monthly fee will apply if you wish to re-join.

You agree to advise us immediately of any changes to Member’s Details provided.

We reserve the right to increase the price of the monthly membership fees. We will give you 1 full months’ notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your membership fee will cost after the increase. During this period, you will have your usual right to terminate your membership, in accordance with the membership terms and conditions and rules. If you do not terminate the membership by the date given to you in the notice, then the price of your membership will be increased in accordance with the notice.

Annual membership is not refundable, however, a 14 day cooling off period is applicable where the service is not used.

Annual memberships may be cancelled by the member upon proof of a change of residence outside of the county or a genuine medical illness that prevents the member from using the facility.  Cancellation due to an illness will require a doctor’s certificate. Annual members may also freeze their memberships upon receipt of a doctor’s certificate.

Gym membership does not include online classes.

Management reserves the right to alter, amend or change the Terms & Conditions and Gym Rules from time to time. The version on our website being the most up to date available.

Members found in breach of the rules of their membership type will be cancelled automatically.

Members are expected to act respectably at all times while using our facilities. Aggressive or unruly behaviour towards staff or other gym members will not be tolerated and will result in termination of your membership. The management of Inis Fitness have the right to refuse membership to any individual without cause.

Services and facilities provided are at the sole discretion of gym management. Services and facilities may be amended at the discretion of the gym management.

GENERAL TERMS

As a member you agree to comply with the rules of the gym, which are prominently displayed, with regards to use of the facilities, health and safety notifications and signage, opening hours, fire evacuation plan and your conduct. From time to time, the Fitness Centre may make reasonable changes to these rules provided the Centre gives advance notice of these changes. If you are not satisfied with these changes you are free to cancel the membership as the terms of joining.

We may terminate this agreement with immediate effect on notifying you if you are in breach of the Fitness Centre Rules.

For security and validation reasons, management reserves the right to scan each member’s code at the reception in the gym.

No entry is permitted without a membership.

Members are not permitted to use the facility to personal train for monetary gain.

All members must sign a Health Commitment Statement before they use the gym facilities.

If you require assistance in using any equipment, please ask a member of our Fitness Team.

Members wishing to report problems with services at the Fitness Centre should contact the Duty Manager (enquire at reception).

Exercising with others is encouraged, however, coaching other gym-goers at the gym is left solely to the personal trainers with whom we exclusively work.  If, despite this, you offer personal training services or operate other commercial activities, this can be a reason for us to terminate your agreement and seek compensation for the damage we suffered.

If you grant access in any way, whether or not they are a member, for example by letting them walk through the entrance gate with you or giving them your pass, you shall be responsible for paying the cost of the day pass.  Inis Fitness maintains the right to block access to the club until the price of the day pass has been paid.  In the event of multiple violations, Inis Fitness has the right to terminate the agreement with immediate effect.

The Centre may withdraw use of all or part of the gym for any purpose of undertaking maintenance work or any other work considered necessary for the efficient operation of the gym.

Fitness Centre facilities include changing rooms, shower facilities, classes, lobby area and studios.

We may assign the benefits of this agreement to a third party on notice to you. Your rights under this agreement will not be prejudiced.

We endeavour to create a club in which everyone is respected and the rules are complied with.  If you do not observe the arrangements of the agreement, or if you seriously and/or repeatedly fail to comply with the house rules or demonstrate unacceptable behaviour, Inis Fitness shall be entitled to terminate the agreement with immediate effect.

Exercising comes with risks.  If you use our facilities, you must be able to assess your own capabilities.  We do not offer active supervision by persons at the gym.  You can arrange an introduction session or make use of the advice and tips that we provide, however, you will always be responsible for the way in which you exercise and the choices you make.  The use of the facilities will be at your own risk.  In the event of any physical conditions we advise you to seek expert advice from a doctor or specialist to determine a correct and sensible way of exercising.

Inis Fitness and our employees are not liable for matererial or immaterial damage as a result of an accident or injury that you sustain in our gym  or because of the use of our equipment.

We recommend that you do not bring any valuables with you to the gym.  Inis Fitness provides lockers, but the use of these lockers is at your own risk.

PHYSICAL ACTIVITY READINESS

Being more active is very safe for most people, however, some

people should check with their doctor before they start becoming much more

physically active.  If you answer YES to

any of the questions below we would ask you to speak to your Doctor and provide

Inis Fitness with a letter confirming it is safe for you to participate in

fitness.  If you answered NO to all of

the questions, you are cleared for physical activity.   Also, if you are over 69 years of age, and

you are not used to being very active, check with your doctor.

1) Has your doctor ever said that you have a heart condition OR

high blood pressure?

2) Have you ever been diagnosed with another chronic medical

condition?

3) Are you currently taking prescribed medications for a chronic

medical condition?

4) Has your doctor ever said that you should only do medically

supervised physical activity?

5) Do you feel pain in your chest at rest when you do physical

activity?

6) Do you lose balance because of dizziness OR have you lost

consciousness?

7) Do you currently have a bone, joint, or soft tissue problem?

Delay becoming more active if:

You have a temporary illness such as a cold or fever; it is best

to wait until you feel better.

If you are pregnant – talk to your physician.

Before you

embark on a physical fitness journey, be sure to check your underlying health,

otherwise, you could do more harm than good.

It is critical that your health is good before you begin an exercise

plan; common sense is your best guide.  By

Agreeing to the Terms and Conditions of your membership you are Agreeing that

you do not suffer from any of the above conditions or have provided a Doctor’s

note confirming it is safe to participate in fitness here.

In order to execute your agreement, we collect your personal data.  Inis Fitness processes your personal data appropriately and with due care and within the framework of the applicable legislation and regulations, such as the General Data Protection Regulation. The Privacy Notice lists which data is processed by us, for which purposes we process it and how we handle the personal data.

This agreement is governed by Irish Law.
