Membership Terms and Conditions

PRINCIPLE TERMS

  1. This agreement commences once you have indicated your acceptance in the Declaration section of the web sign up process.
  2. You will be entitled to all the rights and privileges exercisable for the type of membership chosen.
  3. You must be 16 years or over to join Inis Fitness.
  4. Memberships are not transferrable.
  5. It is the responsibility of the customer to determine which membership agreement best meets their needs, whether that be a fixed term, termed ‘package’ or for an indefinite period, termed ‘Monthly Membership Subscription’.
  6. You manage your own account in your LegitFit account.  Inis Fitness will not intervene in your account, you enter your details and make any amendments to your account.  You may also book classes, update membership and update your personal details.
  7. Members must use our LegitFit Access/Membership App on each visit to gain access to Inis Fitness and must not share their App with anyone else. To download and install the app, you can visit the App or Play Store on your iOS/Android device and search for LegitFit. Tap the “Download” or “Install” button to get the app on your device.

MEMBERSHIP FEES

  • When you become a member, the membership fees are due from the date your membership begins.  This payment is made in advance and in accordance with your membership term.
  • All types of memberships have their own fee and conditions. It is the responsibility of the member or client to be aware of the payment terms and dates of receipt.
  • You cannot transfer your membership or pass it to someone else.  It concerns a personal membership.
  • Membership is paid monthly on a subscription payment basis or in a once off payment.
  • All new subscription payment memberships are processed by a third party on behalf of Inis Fitness.
  • The first month’s membership fee is collected by credit/debit card on your membership application date upon joining online.
  • Your subsequent membership fees will be collected one month after you have joined and will be collected on the same date (or the closest working day each month of your membership). Please take note of the dates shown for your records.
  • Subscription payments will continue on a monthly basis until you notify Inis Fitness of your wish to cease your membership. Cancellation requests must be sent at least two weeks prior to the collection date.  If you fail to provide the stated notification period to Inis Fitness your request to cancel your membership and payments will not be immediately effective.  In this instance the cancellation will then be processed the next period.  Refunds will not be issued in this instance as it is the responsibility of the member to be aware of their own individual payment schedule, without exception.
  • Consecutive repeated non-payment of a subscription payment will result in your membership being automatically cancelled. The prevailing advertised monthly fee will apply if you wish to re-join.
  • You agree to advise us immediately of any changes to Member’s Details provided.
  • We reserve the right to increase the price of the monthly membership fees. We will give you 1 full months’ notice of any incoming price increase and will make it very clear when the price increase will take effect and how much your membership fee will cost after the increase. During this period, you will have your usual right to terminate your membership, in accordance with the membership terms and conditions and rules. If you do not terminate the membership by the date given to you in the notice, then the price of your membership will be increased in accordance with the notice.
  • Annual memberships paid in full are not refundable, however, a 14-day cooling off period is applicable where the service is not used.
  • Annual memberships paid in full may be cancelled by the member upon proof of a change of residence outside of the county or a genuine medical illness that prevents the member from using the facility.  Cancellation due to an illness will require a doctor’s certificate. Annual members may also freeze their memberships upon receipt of a doctor’s certificate.  All other ‘package’ memberships are not eligible for cancellation or refund.
  • Only Annual Gym memberships paid in full are eligible for ‘freezing’ or pausing their membership for a period of time with the presentation of a doctor’s certificate.  It is only in this case that a membership may be frozen for an extended period.
  • In the event of a short illness, such as flu where a doctor’s certificate may not be necessary the Centre uses the discretion to provide a 3-Day ‘freezing’ period for memberships.  This will be assessed on an individual basis.
  • Gym Memberships do not include classes.
  • Management reserves the right to alter, amend or change the Terms & Conditions and Gym Rules from time to time. The version on our website being the most up to date available.
  • Members found in gross breach of the rules of their membership type will be cancelled automatically.
  • Members are expected to always act respectably while using our facilities. Aggressive or unruly behaviour towards staff or other gym members will not be tolerated and will result in termination of your membership. The management of Inis Fitness have the right to refuse membership to any individual without cause.
  • Services and facilities provided are at the sole discretion of gym management. Services and facilities may be amended at the discretion of the gym management.
  • If you want to use our facilities casually or simply want to try it out, you can purchase a day pass.  The day pass provides one-off access on the date to which it is used in the gym. Outlined T’s & C’s will apply to this membership as well.

GENERAL TERMS

  1. As a member you agree to comply with the rules of the gym, which are prominently displayed, with regards to use of the facilities, health and safety notifications and signage, opening hours, fire evacuation plan and your conduct. From time to time, the Fitness Centre may make reasonable changes to these rules provided the Centre gives advance notice of these changes. If you are not satisfied with these changes, you are free to cancel the membership as the terms of joining.
  2. On acceptance of an application for membership, the member will be issued with a QR code, which must be produced on each visit to the gym to gain admission.
  3. For security and validation reasons, management reserves the right to scan each member’s individual QR code at the reception in the gym. This will entail a member’s photo being made visible or projected on the screens at reception.
  4. No entry is permitted without a QR code or explicit permission from Inis staff.
  5. Exercising with others is encouraged, however, coaching others at the gym is left solely to the personal trainers with whom we exclusively work.  If, despite this, you offer personal training services or operate other commercial activities, this can be a reason for us to terminate your agreement and seek compensation for the damage we suffered. Members are not permitted to use the facility to Personal Train for monetary gain. Members are not permitted to film their workouts for monetary gain.
  6. If you require assistance in using any equipment, please ask a member of our Fitness Team.
  7. Members wishing to report problems with services at the Fitness Centre should contact reception.
  8. If you grant access in anyway, whether or not they are a member, for example by letting them walk through the entrance gate with you or giving them your access code, you shall be responsible for paying the cost of the day pass.  Inis Fitness maintains the right to block access to the club until the price of the day pass has been paid.  In the event of multiple violations, Inis Fitness has the right to terminate the agreement with immediate effect.
  9. The Centre may withdraw use of all or part of the gym for any purpose of undertaking maintenance work or any other work considered necessary for the efficient operation of the gym.
  10. Fitness Centre facilities include changing rooms, shower facilities, classes, lobby area and studios.
  11. We may assign the benefits of this agreement to a third party on notice to you. Your rights under this agreement will not be prejudiced.
  12. We endeavour to create a club in which everyone is respected, and the rules are complied with.  If you do not observe the arrangements of the agreement, or if individuals’ seriously and/or repeatedly fail to comply with the house rules or demonstrate unacceptable behaviour, Inis Fitness shall be entitled to terminate the agreement with immediate effect.
  13. Exercising comes with risks.  If you use our facilities, you or, in some cases, your medical professional, must be able to assess and work within your own unique capabilities.  We do not offer active supervision to persons at the gym.  You can arrange an introduction session or make use of the advice and tips that we provide, however, you will always be responsible for the way in which you exercise, choices you make and the level of exertion you attempt.  The use of the facilities will be at your own risk.  In the event of any physical conditions we advise you to seek expert advice from a doctor or specialist to determine a correct and sensible way of exercising.
  14. Inis Fitness and our employees are not liable for matererial or immaterial damage as a result of an accident or injury that you sustain within the gym or because of the use of our equipment.
  15. We recommend that you do not bring any valuables with you to the gym.  Inis Fitness provides lockers but the use of these lockers is at your own risk.  Lockers are only for the time you are in the gym and are not allowed for overnight use.
  16. In order to execute your agreement, we collect your personal data.  Inis Fitness processes your personal data appropriately and with due care and within the framework of the applicable legislation and regulations, such as the General Data Protection Regulation. The Privacy Notice lists which data is processed by us, for which purposes we process it and how we handle the personal data.
  17. This agreement is governed by Irish Law.

GIFT VOUCHERS

  • Vouchers may not be exchanged for cash.
  • Vouchers exchanged for a product at a lower value will be reimbursed in a voucher with the remaining balance. Remaining balances less than €1.00 will be paid in cash; all other balances will be noted on the Member account.
  • Validly activated and verified gift vouchers can be exchanged for another type of Inis Fitness membership up to the value of the voucher or for goods at a higher price upon payment of the difference.
  • The maximum amount that can be credited to a Gift Voucher is €500.
  • Vouchers are subject to verification at time of presentation and we reserve the right not to accept vouchers at our absolute discretion.
  • Vouchers cannot be used in conjunction with another offer or promotion.
  • You must be 16+ to obtain a Inis Fitness Membership.  If a gift card is purchased for someone under 16 years of age, they will be refused Membership and a refund will be given within 30 days.
  • Once the Gift Voucher is redeemed, the credit is not transferrable.
  • Gift Vouchers do not have an expiry date from purchase.
  • Lost or stolen vouchers cannot be replaced, and we accept no liability for lost, stolen or damaged vouchers.
  • You may not sell vouchers at a discount against face value to third parties and the absence of consent or delay in responding to a request for consent shall not be deemed to be consent to sell or offer vouchers at a discount at any time.
  • The above Gift Card Terms and Conditions do not affect your statutory rights as a consumer.

CLASSES

  • Classes are purchased as a bundle or block. Classes may be purchased online through our App or in person at reception.  Some personal details are required from the class attendee to process their class membership.
  • Each class has a specific duration, frequency, start and finish date and location within the facility.
  • It is the responsibility of the class participant to determine if the duration, time and days are suitable for them to attend.
  • It is the responsibility of the class participant to determine prior to payment if the physical demands of the class are within their physical capabilities.
  • Classes for the entire block’ are paid in full prior to commencement of the class.
  • There are no refunds, deferrals or exchanges for the classes that a class participant has paid for and agreed to attend. It is the responsibility of the class participant to consider if the class commitment is achievable prior to payment being made.
  • Participants are expected to arrive to their classes in sufficient respectfully avoiding interruption for the other class members.
  • The same Terms and Conditions as stated in the Gym Membership are applicable to class participants.

BICYCLE RACKS

  1. There are bicycle racks in front of Inis Fitness.  Use of these bike racks is at your own Risk. Security of your bicycle is your responsibility.  Please ensure your bicycle is securely always locked. Management accepts no responsibility for loss or theft of your bicycle, or any items linked to your bicycle whilst on the property.

COMPETITIONS

  1. Competitions are open to Republic of Ireland residents aged 18 and over. Proof of age could be required.
  2. Competitions are not open to employees and their immediate families of Inis Fitness.
  3. Closing dates will be published in the social media post and entries must be submitted before this date.  Entries submitted after final closing date will not be included.
  4. Prize(s) will be described in the social media post are non-transferable.
  5. There is no cash or prize alternative.  In the event of cancellations, there will be no refund of the value of the prize.
  6. By participating in Inis Fitness social media competitions, you agree to be bound by the competition Terms and Conditions.

The rules of the competition will be fully described in the social media post and the winner will be contacted by social media (through private message or reply to the competition entry).

INTELLECTUAL PROPERTY

  • You may not use or adopt any product image, corporate title, designation, service mark, trademark, any intellectual property right or trading name of Inis Fitness or Inis Spa & Leisure Ltd. without our written prior consent.
